Terms and Conditions

Thank you for choosing Mountain Resort Cabin Rentals, LLC for your mountain vacation! The guest understands once you have accepted the terms and conditions below, this reservation is made, and you are committed to the cabin and dates you have chosen.  

Rates & Fees: 
Guests acknowledge, understand, and agree that the moment Guests give Mountain Resort Cabin Rentals their credit card information, Mountain Resort Cabin Rentals is authorized to charge the credit card for the rental amount agreed upon including Cleaning Fees, non-refundable $50 Booking Fee, Processing Fee and 15% Gilmer County lodging tax.  
 
Each reservation is charged a non-refundable $50 fee for a Damage Protection Waiver (DPW). The DPW is designed to protect you from charges up to $300 for accidental damage beyond normal wear and tear. If any damage surpasses $300 additional charges will be applied to the credit card on file, and written documentation will be sent to the guest. If damages are determined to be caused by willful misconduct, misuse, or pets, the DPW will be voided on the grounds of intentional acts, gross negligence, or willful conduct by the guest, licensee of guests, or visitors. These occurrences will result in the guest being charged in full for any damages and fees. The DPW does not cover any additional fees or fines. All accidental damage must be reported to Mountain Resort Cabin Rentals office before departure in order to qualify for protection.  
 
Guests shall provide a guest list and copy of the credit card holder's photo ID prior to driving directions being sent. If you are found to exceed the maximum occupancy of your cabin you will be charged a minimum of $200, and it will be considered a breach of contract and may result in immediate eviction with NO REFUNDS OR REBATES.  

 
WARNING: 
Under Georgia law, there is no liability for an injury or death of an individual entering these premises if such injury or death results from the inherent risks of contracting COVID-19. You are assuming this risk by entering these premises. O.C.G.A § 51-16-3. 
 

Minimum Age Requirement: GUESTS MAKING A RESERVATION MUST BE AT LEAST 25 YEARS OLD. BY SUBMITTING THEIR RESERVATION, THEY ARE CONFIRMING THAT THEY ARE 25 YEARS OLD OR OLDER except for those who are in the presence of their parent(s) or legal guardian(s.) By submitting your reservation you are confirming that you are 25 years old or older and that all of the guests are either 25 years or older, or any who are under 25 are with their parent(s) or legal guardian(s.) NO LARGE GROUPS OF 25YEAR OLDS AND YOUNGER. THE MAXIMUM IS 6 GUEST THAT ARE 25 YEARS OLD AND YOUNGER IN ANY CABIN UNLESS PRE-APPROVED PRIOR TO BOOKING. 

You will receive a confirmation email from [email protected] automatically, then another email asking for guest information.  and copy of the person renting the cabin a Driver's License or Photo I.D. Once we have received your guest list, and Photo I.D. you will receive an e-mail one week prior to your arrival date containing driving directions to the cabin and lockbox code. 
 

Directions: (and Gate Admittance - Coosawattee River Resort Only) will not be sent until we have your complete guest list and vehicle information, along with a Photo I.D. of the Credit Card holder who has made the reservation.  This Information must be sent to us no later than 5 days before arrival. Guests list received within 5 days of arrival is considered “PRIORITY PROCESSING” by Coosawattee River Resort and will result in an extra charge of $25, as this fee must be paid to Coosawattee River Resort.   

Travel Insurance: We strongly suggest Travelers Insurance.  It is 6.95% of your total amount. Purchasing Travel Insurance will give you the peace of mind that in an event outside of your control it will not cause you to lose your total vacation investment. See Plan Details. The plan cost includes the travel insurance premium and assistance services fee. Travel insurance coverages are underwritten by: Generali U.S. Branch, New York, NY; NAIC # 11231, for the operating name used in certain states, and other vital information about the Travel Insurance & Assistance Services Plan, please see Important Disclosures
 
Reservations: A $250.00 prepayment to be applied towards the rental fee, by valid credit card, will secure your reservation with the remaining balance due 21 days before arrival. The same credit card will be used unless you advise us otherwise. Directions (and Gate pass for Coosawattee properties only) will be sent via e-mail 1 week before you check in. 

If you reserve within 21 days of arrival, you will need to pay the total amount due. The guest agrees that the premises shall be occupied for no more than the amount stated in this contract. Absolutely no overnight guests are allowed, other than those stated in the contract.  
 
All people are to be included in the total occupancy count. The total guest occupancy count cannot exceed the stated number of occupants for each cabin. Please e-mail a final guest count to us 14 days prior to arrival. 

Occupancy by guests other than those listed in this agreement will result in the termination of the rents and the forfeiture of all rental fees and deposits.  

Guests shall provide a guest list prior to driving directions being sent. If you are found to exceed the maximum occupancy of your cabin you will be charged a minimum of $200, and it will be considered a breach of contract and will result in immediate eviction with NO REFUNDS. 


Cancellation - Guest List Policy: To cancel your reservation you must email and call us to cancel. In the event of cancellation, the following will apply: Reservations canceled more than 30 days prior to arrival, the full deposit will be returned minus a cancellation fee of $100.00.  Reservations canceled 22 to 29 days prior to arrival will be charged a $250.00 cancellation fee. For reservations canceled 21 days (or less) prior to date of arrival, the guest is responsible for the amount of the booking and your card will be charged in full.  
 
 
Refunds: No Refunds for any reason if guest cannot come or leaves early. 
This Cabin Rental Agreement is a legally binding agreement between Guests, Agency & Owner. Your reservation binds you to a specific period of time. Mountain Resort Cabin Rentals will make every reasonable effort to correct any problem that arises during your stay in a timely manner. There should be no expectation of a refund, and there will be no refund or relocation because you are disappointed with the property you have chosen to rent or in the event something associated with the property is not working to your satisfaction. There will be no refunds or compensation for: Adverse Weather or Natural Disasters that prohibit you from reaching your destination nor acts of war or government agencies, road maintenance, gas shortages, power outages or water outages etc. Early departures and/or weather conditions that make access difficult will not result in refunds. 
Cancellations less than 21 days prior to check-in will not be refunded.  
 

Conduct: These are not party cabins. We expect them to be treated with respect. Any Renter who is not orderly will be evicted by the owner (or owner’s representative), the local law enforcement or the community security company will escort you out.  
Please understand these cabins are privately owned and well loved. We want you to have a wonderful time and enjoy the Cabin and Resort, but we must protect our owners.  

Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents, including but not limited to; parties, excessive speeding through neighborhoods, riding of ATVs or Off-Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, BB/Pellet Guns, Paint Ball Guns, Potato Cannons, or Fireworks, etc.  

The Agents have the prerogative to terminate this Agreement/Contract and to demand that disruptive Guests vacate the premises, thereby forfeiting all monies to Agents.
No Refunds or Rebates will be offered.  
 

All Cabins Are Non-Smoking: Guests may smoke outside on the decks or porch areas. Ashtrays are provided outside. Cigarette butts must not be disposed of in the yard or anywhere on the property. If it is found that any member of the rental party or guest of the rental party has smoked inside the cabin, Guests agree to pay up to $300 to rid of the smell of cigarette smoke in curtains, furniture, linens etc. and to remove cigarette butts that are left on the ground.  

Pet Policy (Dogs Only): We offer pet friendly cabins. The fee is $50.00 per pet, per stay. We also have cabins where absolutely no pets are permitted in or on said property. Out of respect for our homeowners and guests with allergies we cannot make an exception no matter how small the pet may be.  
If a pet belonging to any member of the rental party or guest of the rental party is found to be in or on the premises, Guest will be removed from the property by the local law enforcement or the community security company. Guest agrees to pay an additional fee up to a $300 and acknowledges that any damage done by said pet shall be his/her monetary responsibility.  Guests acknowledge, understand, and agree that for Agents to continue their very lenient Pet Policy, the following items must be adhered to: Pets are not permitted in hot tub. Guests agree to pay not less than $100 cleaning fee if a pet gets into the hot tub. 

Pets must be completely housebroken, well behaved, and pest free. Pets are not allowed on furniture nor on or in beds. Guests will be charged a cleaning fee of not less than $100 if pet hair causes a delay in cleaning services. Guests agree that they will not use any linen or towels on pets other than the pet towels provided by Agents or brought by Guests.  

Pets shall be left in a crate while alone in the cabin. Pets should not be left alone in a fenced backyard. Guests agree to pay for any damage caused by pets. If pets have an accident in cabin, the guests will perform all clean-ups. Guests further agree to police waste from the grounds and deposit in a sealed bag, then put into outside garbage cans. Guests agree that failure to comply with clean-ups of either inside cabin or outside cabin will result in an additional cleaning charge of not less than $100. 

If any of the Pet Policy items are not met, Guests are in violation of this Agreement/Contract. Guests agree that by signing this Agreement/Contract, they are authorizing Agents to charge Guest's credit card on file for any damages sustained. 
 

Items Left Behind: Agents are not responsible for any items Guests leave behind in cabin. Agents are authorized to charge a fee of $25 plus shipping costs for the return of any items Guests leave behind in cabin.  

Listing Information: Information regarding individual listings are accurate.  

Property Damage: Guest acknowledges and understands that he/she is financially responsible for all property damage that may occur during the stated rental period which can reasonably be attributed to the rental party's negligence or abuse. 

Furniture/Furnishings: All furniture/furnishings in the cabin are in place as the owners wish them. Guests agree to pay not less than $100 if furniture is rearranged in such a manner that results in cleaning services being delayed. If the furniture/furnishings are found damaged after guest checkout, the Guests agree to pay no less than $100 to have the furniture repaired or replaced.
 

Garbage: All trash in the cabin must be bagged in no less than a 13-gallon kitchen trash bag (4 bags are provided). The bags must be tied and placed in the Trash/Bear Bins located outside. If your cans have black liners in the trash bins, they are there to keep bins clean only. Do not place trash loose trash in the Trash/Bear Bins as the Trash Vendor will not pick up any loose trash. Loose trash includes Walmart, Dollar General or other shopping bags. There will be an additional fee of up to $125 for any loose trash found in the Trash/Bear Bins. 
 
Each home is furnished with exterior trash bins or a bear bin. The number of bins is based on the maximum occupancy of the home. Please do not over stuff trash cans.  

If your garbage will not fit into the garbage cans or bear bins provided, you will be responsible for taking off excess garbage to avoid an additional housekeeping fee of $125.00. Should wildlife tear into garbage due to negligence on the part of the Guests by not securely placing all trash in cans with lids on, the Guests will incur the additional housekeeping fee of $175.00 plus an additional housekeeping fee of $125.00 for removing garbage from yard area. Directions to trash discarding areas are in the Welcome Book at each cabin.  


Checkout Procedures: Guests understand that the property must be left clean and undamaged. Guest understands that failure to follow the post check-in and checkout procedures may result in an additional fee of up to $300, and that Agent reserves the right to further bill him/her for additional cleaning or repairs. Photos will be provided to the guest of the condition of the cabin. 

Guests agree to read all the documents provided at check-in, and those printed in the information book and posted policies provided in the cabin. The owners have left a journal in the cabin and would love to hear about your vacation stay and cabin experience.  


Property Owner Belongings: No items belonging to the cabin owner shall be taken from the property. Guests will not use towels, blankets, or sheets for trips to the river, lakes, picnic areas, etc. Guests will provide their own from home and not risk loss of owner`s property. Guests agree to pay a charge of no less than $75 per towel, blanket, or sheet if removed from the cabin.
 

Upon Arrival: Please report any damage or shortage of supplies to the office immediately.  

Key Return: Guests are responsible for the return of the property key. The keys are to be returned to the lockbox when leaving. If the property key is not returned upon check-out, Guests agree that Agents are authorized to charge the credit card on file for the costs of re-keying or replacing all the locks and re-issuing new keys to owners, cleaning crews, and Agents.  

Upon Departure: The house is locked up and all keys are present and in their appropriate places, i.e., the front door key is in the lock box; the front door and windows are all locked.  

Grills: Propane gas for the grill is TURNED OFF, the grill is cool, and the cover is put back on. 
 

Lock Out: A lock out of Guests from cabin will result in a $50 service call during business hours. Guests agree that a lock out after business hours will result in a locksmith being called and Guest's credit card being charged accordingly.  

Check-In and Checkout Time: Guest acknowledges and understands that check-in time is not earlier than 4:00 P.M. and checkout time is no later than 10:00 A.M. on the dates agreed upon. Guest agrees that an unapproved late check-out or early check in will be assessed an amount equal to one-half of the nightly rental fee.  

Reservation Check-In not allowed on Easter Sunday, Memorial Day, 4th of July, Labor Day, Thanksgiving Day, Christmas Day or New Year's Day. 

Housekeeping cannot be disturbed during this time of cleaning between 10:00 a.m. and 4:00 p.m. Mountain Resort Cabin Rentals, LLC., has driven to the properties and the directions are precise down to a science. If you forget your directions or cannot follow the directions the following policy is in effect.  

If you must call for an escort to the property, there will be a $50.00 charge during normal business hours, 9am-5pm Monday through Friday, Saturday 10am-2pm, and closed on Sundays. A $100.00 charge on weekends and after hours.  

GPS Does Not Always Work Well Here in Ellijay, So Please Use the Directions We Email to You


Resort Fee (required): Experience the best of Coosawattee River Resort with our required $60.00 Resort fee for your entire party. This fee grants access to the 5 picturesque parks along the river, Pavilion Picnic Areas featuring charcoal BBQ grills, a Fishing Pond with no license required, and a fenced-in Dog Park.  
 
Your cabin comes with 2 Amenity Cards, located in the front pocket of the Welcome Book, providing entry for up to 8 guests to enjoy a wide range of amenities. Indulge in the year-round Olympic indoor heated pool, 2 outdoor pools (available from Memorial Day through Labor Day), a well-equipped gym, an exciting arcade, and various sports facilities like tennis, pickleball, basketball, and mini golf. If your party exceeds 8 people, you can easily purchase an additional Amenities Card for $59 at the Coosawattee Welcome Center, conveniently located at 25 Eagle Mountain Drive, Ellijay, GA 30540. These amenities are just a short drive from your cabin.  
 
While we strive to provide uninterrupted access to our amenities, we are not liable for closures or non-use resulting from weather conditions, maintenance, or other factors. Kindly understand that refunds will not be issued.  
 

Amenity Card Policy: Please ensure that the amenity cards provided are left in the cabin when you checkout. Failure to do so will result in a replacement fee of $65.00. Thank you for your cooperation.  
  
We ask that you contact our office upon arrival to report anything you see that is not right, i.e., broken, non-functional, etc. Likewise, we ask you to contact us as soon as possible if something is broken or damaged while you are occupying the cabin. 

 
Payment of Fees: All rentals are to be paid in full before occupancy of property takes effect and will be done in the following manner: Reservation deposit of one half is to be paid in advance to secure the dates requested. Reservation deposit will apply toward rental rate balance due 21 days before arrival. Reservations made 21 days or less before the arrival date, 100% prepayment is required.  
We accept Credit cards (Visa, MasterCard, and Discover). Please have the final guest count to us 14 days prior to your arrival. 
 
Long-distance calls will be paid for by the renter. PLEASE be sure the number you are calling is a LOCAL call and not a toll call. Please bring a calling card. Any billable calls made during the stated rental period that are charged to the owner will be billed to the Guest along with a $30.00 processing fee, upon receipt of charges. 


Hot Tubs: Please do not put ANYTHING in the hot tubs. This includes dish soap, bubble bath, oils, drinks, pets, or any chemicals. If extra cleaning is required for the hot tub, you will be billed. Guests may not add any objects to the hot tubs.  
Guests agree to pay not less than $150, if the hot tub has been compromised in such a manner that results in cleaning services being delayed. The hot tubs are cleaned prior to Guest's arrival.  

Guests agree to pay an additional charge of $50 if Guests request an additional cleaning of hot tub during Guest’s stay.  
Guests understand that hot tub usage is at their own risk and will not hold Agent or Property Owner responsible for any injury. It is absolutely forbidden for children to be in the hot tub without a responsible adult.  


Fireplace & Fire Pits: Seasonal use of the Fireplaces is October 1st through April 1st. One or more of the fireplaces in some of these properties may be wood burning. Fire Pits Year-Round. One or more of the fireplaces may be gas started and are equipped with PROPANE LOGS.  
 
If a property does not offer a fire pit guests will not make one, doing so is considered damage and guests will be charged accordingly. Guest agrees that no burning or smoldering fireplaces or fire pits shall be left by guests, "EVER". Guests agree to pay not less than $100, if any items other than hardwood or Duraflame type logs are burned in the fireplace. Guests further agree that no fire will be left unattended. 
 
The guest agrees that under NO CIRCUMSTANCES will any member of the party rearrange the logs, remove the logs, or burn anything other than the propane logs provided in the gas fireplace. DO NOT MOVE THE LOGS IN THE GAS FIREPLACES. You will be charged a fee of up to $300 for the logs to be arranged correctly and for cleaning the fireplace. Guests need to understand moving the logs may cause damage to the logs and may also allow poisonous gas to leak into the cabin which could prove harmful to either your party or future guest.  

Check the amenities to see if your cabin has gas or wood burning fireplaces. FOR WOOD FIREPLACES ONLY, ABSOLUTELY NO LIQUID ACCELERANTS IS ALLOWED!!! THIS IS A SAFETY ISSUE.  
 
All gas starters in wood burning fireplaces ARE NOT AVAILABLE.  Guests are responsible for their own starter logs and matches. NO LIGHTER FLUID ALLOWED.  

Guests agree to pay an additional fee up to $300 if there is any evidence of use of an accelerant, and guests will be removed by security. We take this very seriously. The fireplace should NEVER BE UNATTENDED. All fireplaces are seasonal and are operational from October 1 through April 1. Nothing shall be burned in gas log units and nothing other than hardwood or Duraflame type logs CAN be burned in wood burning fireplaces.  


Disputes: This agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia and shall be treated as though it were executed in the county of Gilmer, State of Georgia. Any action relating to this agreement shall be instituted and prosecuted only in the Gilmer County Magistrate or Superior Court in the State of Georgia. Guest(s) specifically consents to such jurisdiction and to extraterritorial service process.  

No Firearms, Fireworks or ATVS: The occupancy and use of the premises shall be such as not to place the property the Rental guest(s) or guest(s) of the Rental party in danger or to disturb and/ or offend area neighbors. The agent has the right to terminate this agreement and request loud or unruly guests to vacate the property immediately. This discharge shall not result in the refund of any rental fees.  

Wildlife: All our cabins are located in the Mountains of North Georgia, with most of them in the Coosawattee River Resort. You are very likely to encounter wildlife such as deer, squirrels, raccoons, bears, snakes, spiders, and bugs of various types. Neither Mountain Resort Cabin Rentals nor the property owner will accept responsibility for any injury caused by said wildlife.  

Loss of personal items: Guest acknowledges and understands that each guest or friend of the rental guest is solely responsible for any loss by any person while in residence including the loss of money, jewelry, or any other personal items. 
 

NO SHOW/EARLY DEPARTURE POLICY: Agents are not responsible for Guest's inability to arrive or if Guests chooses to depart early for any reason, or if members of Guests party do not show up. All guests must be finalized 14 days before arrival. NO REFUNDS OR REBATES will be offered.
  

Refunds: This Cabin Rental Agreement is a legally binding agreement between Guests, Agency & Owner. Your reservation binds you to a specific time period. Agent will make every effort to correct any problem that arises during your stay in a timely manner. There should be no expectation of a refund, and there will be no refund or relocation because you are disappointed with the property you have chosen to rent or in the event that something associated with the property is not working to your satisfaction.  

There will be no refunds or compensation for: Adverse weather or natural disasters, acts of war or government agencies, road maintenance, gas shortages, power outages or water outages etc. Early departures and/or weather conditions that make access difficult will not result in refunds.  
Even though paved and gravel roads are well maintained at Coosawattee, please remember that mountain roads can be curvy and steep. There are numerous routes that will allow you access to our property. 
 
Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of all payments received and the party will not be permitted to check-in. Exceptions: Any exceptions to the above-mentioned procedures must be approved in writing in advance.  
Disclaimer: All cabins handled by Mountain Resort Cabin Rentals, LLC are privately owned. Owners and Agent are not responsible for any accidents, injuries or illness that occur while on the premises or its facilities.
  
Guest acknowledges that each and every guest is solely responsible for any accident or injury to any person while in-residence, and neither the Owner nor Agent accepts any legal or financial responsibility.  

Guests and guardians assume all risk of injury or other loss resulting from any recreational activity and will hold the Agent and Owner harmless with respect thereto. Guest(s) hereby agrees to indemnify and hold Mountain Resort Cabin Rentals, LLC of North Georgia and/or the property owner harmless from all claims, including those of third parties that arise out of, or in any way, are a result of the Guests' use of the premises or items therein.  

Although Mountain Resort Cabin Rentals works very hard to make sure all items in the cabins are operational, we cannot guarantee that all things will be in working order when you arrive. Some items may break, and need to be replaced such as lost board games, broken pool cues etc.  
We do our best to have these items replaced as soon as possible. We cannot be responsible for the failing of any other company's error or service interruption (i.e., electricity, water, gas, etc.). We try our very best to be sure that all things are present and operational but cannot guarantee it.  However, we guarantee that we will do all that is humanly possible to remedy any issue in the shortest time possible.  


Termination By Owner / Substitutions: Agents strive to comply with all reservation requests for specific vacation properties. However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstances, Agents cannot absolutely guarantee a specific property.  Agents reserve the right to change property unit assignment without liability should rental property become unavailable. Where comparable properties are not available Guests will have the option of selecting from available properties at the published rate or receiving a complete refund. Mountain Resort Cabin Rentals reserves the right to substitute a comparable cabin in the unlikely event that the reserved cabin is unavailable for any reason. 
 

Maintenance: In case of a breakdown of any property equipment, guests shall notify Mountain Resort Cabin Rentals immediately so we have an opportunity to make the necessary repairs that may arise during your stay in a timely manner. We cannot guarantee heat, air conditioning, electricity, water, any appliances, cable, satellite, television, telephones, electronics, gas logs, grills, etc. NO REFUNDS will be given. Should a repair person make a call to repair or replace a unit that is found to be in non-working order and the problem was due to Guest's oversight, neglect or misuse, Guests agree that the repair call costs may be billed to the Guests credit card on file. 
 

Right of Entry: Guest(s) agrees that the property manager or representative of the property management company reserves the right to enter the cabin at any time to investigate disturbances, check occupancy, check for damages, to make repairs, alterations, or improvements. Once we receive this agreement, we will be sending you confirmation of your reservation.  
Also, upon receipt of this agreement, please read the confirmation and the attached rental agreement very carefully regarding the accuracy of the dates, and number of people accompanying you to the cabin. The maximum occupancy is stated in all accommodation descriptions.  
 
Rollaway beds, inflatable mattresses and sleeping bags are prohibited. If you are found to exceed the maximum occupancy of your cabin it will be considered a breach of contract and will result in immediate eviction with 
No Refunds.  

We want you to have a safe and memorable time staying here in our beautiful cabins in the North Georgia Mountains in Ellijay.
